Il est restitu\u00e9 au m\u00eame lieu. Tous&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">les frais engag\u00e9s par le loueur pour r\u00e9cup\u00e9rer un v\u00e9hicule restitu\u00e9 ailleurs sont int\u00e9gralement \u00e0 la charge&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">du locataire.<\/strong><\/p>\n<p><strong>Le locataire doit obtenir une autorisation du loueur pour sortir le v\u00e9hicule du territoire fran\u00e7ais.<\/strong><\/p>\n<p><strong>ARTICLE 2. &#8211; MISE A DISPOSITION DU V\u00c9HICULE<\/strong><\/p>\n<p><strong>2.1. &#8211; \u00c9tat du v\u00e9hicule : Le locataire reconna\u00eet que le v\u00e9hicule ne comporte aucune marque apparente&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">de d\u00e9t\u00e9rioration, est en bon \u00e9tat de marche et \u00e9quip\u00e9 pour satisfaire aux conditions impos\u00e9es par le&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">Code de la Route et les diff\u00e9rentes r\u00e9glementations propres \u00e0 sa carrosserie et \u00e0 ses \u00e9quipements.<\/strong><\/p>\n<p><strong>Toute contravention \u00e0 ces r\u00e8glements demeurera l&rsquo;affaire du locataire et \u00e0 sa charge. Toute r\u00e9serve&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">\u00e9ventuelle doit \u00eatre formul\u00e9e par le locataire ou son pr\u00e9pos\u00e9 au moment de la prise en charge du&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">v\u00e9hicule.<\/strong><\/p>\n<p><strong>2.2.- Documents de bord, \u00e9quipement et accessoires :&nbsp;<\/strong><strong>Le v\u00e9hicule est muni de tous les documents,&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">\u00e9quipements et accessoires requis par le Code de la Route et la l\u00e9gislation fran\u00e7aise.<\/strong><\/p>\n<p><strong>Le locataire supportera seul les cons\u00e9quences de la non pr\u00e9sentation de ces documents aux agents de&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">contr\u00f4le et de l&rsquo;utilisation irr\u00e9guli\u00e8re de ces documents, \u00e9quipements et accessoires.<\/strong><\/p>\n<p><strong>Si les uns et les autres ne sont pas restitu\u00e9s \u00e0 l&rsquo;\u00e9ch\u00e9ance de la location, celle-ci continue \u00e0 courir jusqu&rsquo;au&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">jour de la production par le locataire d&rsquo;une attestation officielle de perte, les frais de reconstitution ou&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">de remise en \u00e9tat \u00e9tant enti\u00e8rement \u00e0 sa charge.<\/strong><\/p>\n<p><strong>2.3. &#8211; Carburant :&nbsp;<\/strong><strong>Le v\u00e9hicule est mis a la disposition du locataire le plein de carburant fait.<\/strong><\/p>\n<p><strong>ARTICLE 3. &#8211; DUR\u00c9E DE LA LOCATION<\/strong><\/p>\n<p><strong>La location est consentie pour une dur\u00e9e d\u00e9termin\u00e9e. Elle part du jour de la mise \u00e0 disposition de la&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">totalit\u00e9 du mat\u00e9riel lou\u00e9 dans l&rsquo;agence du loueur. Elle prend fin le jour o\u00f9 la totalit\u00e9 du mat\u00e9riel lou\u00e9 est&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">restitu\u00e9e dans les conditions d\u00e9finies a l&rsquo;article 10.<\/strong><\/p>\n<p><strong>ARTICLE 4. &#8211; GARDE ET CONDITIONS D&rsquo;UTILISATION DU V\u00c9HICULE<\/strong><\/p>\n<p><strong>4.1.- Transfert de la garde juridique :&nbsp;<\/strong><strong>La prise de possession du v\u00e9hicule a l&rsquo;agence du loueur transf\u00e8re&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">la garde juridique du mat\u00e9riel au locataire qui en assure la pleine responsabilit\u00e9 au sens des articles&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">1382 et 1384 du Code civil.<\/strong><\/p>\n<p><strong>La location \u00e9tant conclue en consid\u00e9ration de la personne du locataire, il est interdit \u00e0 ce dernier de&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">sous-louer et \/ ou pr\u00eater le v\u00e9hicule sans l&rsquo;accord \u00e9crit du loueur.<\/strong><\/p>\n<p><strong>4.2. &#8211; Conditions d&rsquo;utilisation :&nbsp;<\/strong><strong>Le locataire doit informer le loueur des conditions d&rsquo;utilisation du&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">mat\u00e9riel lou\u00e9. Le locataire est responsable de tout dommage r\u00e9sultant d&rsquo;une utilisation dans des&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">conditions autres que celles valid\u00e9es par le loueur. Le locataire ne peut utiliser le mat\u00e9riel sur des<\/strong><\/p>\n<p><strong>chantiers soumis \u00e0 un risque d\u2019exposition \u00e0 l\u2019amiante sans l\u2019accord pr\u00e9alable du loueur et fixation entre&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">les parties des modalit\u00e9s sp\u00e9cifiques de d\u00e9contamination et de restitution. Le locataire s&rsquo;engage \u00e0 utiliser&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">le v\u00e9hicule exclusivement sur les aires de roulage et les itin\u00e9raires compatibles avec les caract\u00e9ristiques&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">du v\u00e9hicule. Il s\u2019engage \u00e9galement \u00e0 utiliser le v\u00e9hicule en prenant toutes les dispositions de s\u00e9curit\u00e9&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">n\u00e9cessaires. Le locataire est responsable des infractions au Code de la Route. Il sera \u00e9galement&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">responsable des cons\u00e9quences de tout d\u00e9passement du poids total roulant du v\u00e9hicule ou du nombre&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">de personnes autoris\u00e9es, indiqu\u00e9s sur la carte grise.<\/strong><\/p>\n<p><strong>4.3.- Mat\u00e9riel transport\u00e9 :&nbsp;<\/strong><strong>Le locataire s&rsquo;engage \u00e0 ne transporter sur le v\u00e9hicule que des marchandises&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">conformes \u00e0 l&rsquo;usage auquel il est affect\u00e9. Il s&rsquo;interdit de charger des mati\u00e8res dangereuses ou des&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">mat\u00e9riaux susceptibles de d\u00e9t\u00e9riorer le v\u00e9hicule ou d&rsquo;y laisser des impr\u00e9gnations persistantes, tant par&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">eux-m\u00eames que par leur emballage ou arrimage. Les op\u00e9rations de chargement et de d\u00e9chargement&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">doivent \u00eatre op\u00e9r\u00e9es avec les pr\u00e9cautions suffisantes.<\/strong><\/p>\n<p><strong>4.4. &#8211; Conduite des v\u00e9hicules :&nbsp;<\/strong><strong>Le locataire confiera la conduite du v\u00e9hicule exclusivement \u00e0 des&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">conducteurs titulaires d&rsquo;un permis de conduire en \u00e9tat de validit\u00e9 depuis plus d&rsquo;un an correspondant&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">au tonnage et \u00e0 la cat\u00e9gorie du v\u00e9hicule et autoris\u00e9s par le loueur. Le conducteur devra \u00eatre \u00e2g\u00e9 d&rsquo;au&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">moins 21 ans.<\/strong><\/p>\n<p><strong>Les conducteurs devront se conformer strictement aux instructions du loueur concernant la bonne&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">utilisation du v\u00e9hicule.<\/strong><\/p>\n<p><strong>ARTICLE 5.- ENTRETIEN DU V\u00c9HICULE<\/strong><\/p>\n<p><strong>Le locataire proc\u00e9dera r\u00e9guli\u00e8rement et sous son enti\u00e8re responsabilit\u00e9 aux v\u00e9rifications et appoints de&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">tous les niveaux (huile, eau et autres fluides), ainsi que du degr\u00e9 de concentration d&rsquo;antigel.<\/strong><\/p>\n<p><strong>Le locataire contr\u00f4lera r\u00e9guli\u00e8rement la pression des pneumatiques et leur bon \u00e9tat en fonction de la&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">r\u00e9glementation du Code de la Route. En cas de d\u00e9t\u00e9rioration des pneumatiques pour une cause autre&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">que l&rsquo;usure normale, le remplacement est effectu\u00e9 par le loueur \u00e0 la charge du locataire.<\/strong><\/p>\n<p><strong>Il fera proc\u00e9der \u00e9galement, suivant les prescriptions du constructeur et les consignes du loueur dont le&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">locataire reconna\u00eet avoir eu notification, aux op\u00e9rations d&rsquo;entretien courant et de pr\u00e9vention, notamment&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">de vidange et de graissage, dans les \u00e9tablissements du loueur ou ceux d\u00e9sign\u00e9s par ce dernier.<\/strong><\/p>\n<p><strong>ARTICLE 6. &#8211; R\u00c9PARATION DU V\u00c9HICULE<\/strong><\/p>\n<p><strong>En cas de panne du v\u00e9hicule lou\u00e9, le locataire s&rsquo;engage \u00e0 en informer le loueur sous 48 heures. Aucune&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">r\u00e9paration ne pourra \u00eatre effectu\u00e9e sans l&rsquo;autorisation pr\u00e9alable du loueur.<\/strong><\/p>\n<p><strong>Le contrat est suspendu durant la dur\u00e9e de la r\u00e9paration en ce qui concerne le paiement mais reste en&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">vigueur pour toutes les autres obligations.<\/strong><\/p>\n<p><strong>Si la dur\u00e9e de la r\u00e9paration exc\u00e8de 10% de la dur\u00e9e de location pr\u00e9vue au contrat, ou une semaine&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">calendaire, le locataire dispose d&rsquo;un droit de r\u00e9siliation du contrat de location en ne r\u00e9glant que les&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">loyers courus \u00e0 la date d&rsquo;immobilisation du v\u00e9hicule, \u00e0 l&rsquo;exclusion de tous dommages et int\u00e9r\u00eats quels&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">qu&rsquo;ils soient si la dur\u00e9e de location n&rsquo;exc\u00e8de pas une semaine calendaire, le droit de r\u00e9siliation est ouvert&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">d\u00e8s que le v\u00e9hicule n&rsquo;aura pas \u00e9t\u00e9 remplac\u00e9 au cours du jour ouvr\u00e9 qui suit l&rsquo;information donn\u00e9e au loueur.<\/strong><\/p>\n<p><strong>La r\u00e9siliation est subordonn\u00e9e \u00e0 la restitution du v\u00e9hicule. Aucun dommage et int\u00e9r\u00eat ne pourra \u00eatre&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">r\u00e9clam\u00e9 par le locataire.<\/strong><\/p>\n<p><strong>Si la r\u00e9paration est rendue n\u00e9cessaire par la faute prouv\u00e9e du locataire, ce dernier ne pourra se pr\u00e9valoir&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">d&rsquo;aucun des droits mentionn\u00e9s au pr\u00e9sent article.<\/strong><\/p>\n<p><strong>ARTICLE 7. &#8211; RESPONSABILIT\u00c9S<\/strong><\/p>\n<p><strong>Le locataire est responsable de l&rsquo;ensemble des dommages caus\u00e9s au v\u00e9hicule lou\u00e9, y compris le risque&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">de circulation et\/ou le risque de fonctionnement lors de manoeuvres ou de travaux.<\/strong><\/p>\n<p><strong>Les op\u00e9rations de conduite, de transport et de manoeuvre sont sous la responsabilit\u00e9 du locataire.<\/strong><\/p>\n<p><strong>Le locataire se reconna\u00eet responsable des d\u00e9gradations autres que l&rsquo;usure normale subies par le v\u00e9hicule&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">(tant par la m\u00e9canique que la carrosserie), ses \u00e9quipements ou ses accessoires du fait du non respect&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">des clauses de l&rsquo;article 4 ou pour toute cause \u00e9trang\u00e8re au fait du loueur.<\/strong><\/p>\n<p><strong>Le locataire demeure seul responsable, en vertu des articles L21 et L21-1 du Code de la Route, des&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">amendes, contraventions, et proc\u00e8s-verbaux. Il est \u00e9galement responsable des poursuites douani\u00e8res&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">\u00e9tablies contre lui. en cas de non restitution des clefs et des papiers ou en cas d&rsquo;accident non d\u00e9clar\u00e9 dans les 48 heures.<\/strong><\/p>\n<p><strong>&#8211; en cas de non respect des clauses de l&rsquo;article 4 des pr\u00e9sentes conditions g\u00e9n\u00e9rales de location.<\/strong><\/p>\n<p><strong>&#8211; en cas de surcharge, de d\u00e9faut d&rsquo;entretien ou de n\u00e9gligence du conducteur.<\/strong><\/p>\n<p><strong>&#8211; en cas de d\u00e9g\u00e2ts cons\u00e9cutifs \u00e0 un choc aux parties sup\u00e9rieures (porche, pont, obstacle en hauteur).<\/strong><\/p>\n<p><strong>&#8211; en cas de d\u00e9g\u00e2ts caus\u00e9s \u00e0 l&rsquo;int\u00e9rieur des carrosseries par suite du d\u00e9placement de la marchandise.<\/strong><\/p>\n<p><strong>&#8211; en cas de destruction totale du mat\u00e9riel ou de la mise en \u00e9pave du v\u00e9hicule lorsque le conducteur a&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); Dans le cadre de la politique de d\u00e9veloppement&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">durable, une contribution environnementale sera factur\u00e9e en % de la prestation location. Il s&rsquo;applique \u00e9galement au kilom\u00e9trage hors forfait.<\/strong><\/p>\n<p><strong>11.2. &#8211; D\u00e9termination du kilom\u00e9trage :&nbsp;<\/strong><strong>Le nombre de kilom\u00e8tres parcourus par le v\u00e9hicule est&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">d\u00e9termin\u00e9 par r\u00e9f\u00e9rence au compteur kilom\u00e9trique suivant les normes du constructeur. En cas de&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">violation du compteur, le locataire sera tenu de verser une indemnit\u00e9 forfaitaire de 500 km par jour de&nbsp;<\/strong><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align); font-size: 1rem;\">location.
